Public appointments: what are they, and why do they matter?

Public appointments – senior appointments made by ministers to various public service roles – are vital to the working of government, but some have attracted controversy in recent years. Lisa James explains how public appointments work, and how they might be reformed.

Background

Public appointments – various senior appointments made by ministers to public bodies – can have a major impact on how well the public sector operates. Though the system often works smoothly, recent years have seen some high-profile controversies linked to public appointments, notably those surrounding Paul Dacre’s application to be chair of Ofcom, and the appointment of Richard Sharp as chair of the BBC. These and other cases have raised questions about whether the system now needs additional safeguards.

Why do public appointments matter?

These appointments include senior roles across a wide range of public bodies – including delivery or policy advisory bodies, regulators and funders, as well as departmental non-executive directors. They also include individual roles (for example, commissioners for victims, further education, or children).

The holders of public appointments can therefore have a major impact on the successful delivery of policy and services. A well-functioning public appointments process, which can engage and deliver the best candidates, matters for the quality of governance. This is demonstrated in countries where control over appointments has allowed backsliding leaders (i.e. those who seek to erode democracy) to install allies in key positions.

Given that the holders of public appointments are so important to the working of government, ministers understandably want to be confident that these posts are held by people who are in sympathy with their aims and approach. But it is important for public trust – and successful delivery – that appointments are also made on merit, and cronyism or patronage is guarded against.

Rebuilding and renewing the constitution: the executive

A new Constitution Unit report by Meg Russell, Hannah White and Lisa James, published jointly with the Institute for Government, provides a menu of constitutional reform options ahead of political parties’ manifesto preparation. Its chapters appear on this blog throughout August, with this first excerpt identifying potential changes to the executive branch.

In recent years there have been significant concerns about the functioning of central government, including but not confined to ethical standards. Perennial tensions in the relationship between ministers and the civil service have been exacerbated by the political stresses of the Brexit process and the Covid pandemic, culminating in some politicians’ attacks on the civil service, and some high-profile removals of permanent secretaries under the Johnson and Truss premierships. Since becoming Prime Minister, Rishi Sunak has repeatedly missed opportunities to match his actions to his widely welcomed assertion on the steps of Downing Street that he wanted to lead a government of ‘integrity, professionalism and accountability’. Various episodes have also raised questions about whether the UK’s standards regulators have the status and powers required adequately to perform their roles.

Yet public opinion research by the Constitution Unit shows that people give great emphasis to the importance of honesty and integrity in their politicians, and want independent regulatory mechanisms that punish bad behaviour. Reforms in these areas could help both to increase public trust in politics and promote good governance. The Committee on Standards in Public Life (CSPL), parliamentary committees and external experts have made various recommendations for specific changes. While these are partly targeted at stabilising the situation, experts also agree that there is scope to go further to strengthen constitutional regulators, and to clarify the role, duties and accountability of the civil service. Some changes in this area lie squarely in the government’s power and could be quickly and easily implemented. Some others would require legislation, or benefit from wider consultation. There are also some larger questions which remain more controversial.

Quick wins

  • The Prime Minister should commit to treating civil servants and constitutional regulators with respect and avoiding negative public briefing against them, requiring members of the Cabinet and governing party to abide by the same principle. Impartial civil servants and other independent officials serve the public interest, and can rarely answer back. They should not be beyond constructive criticism, but undermining confidence in them risks damaging trust in the political system as a whole.
  • The Independent Adviser on Ministers’ Interests should be given the power to open his or her own investigations into alleged breaches of the Ministerial Code, and publish their findings, without requiring the Prime Minister’s authorisation to do so. This has been recommended by CSPL and numerous other bodies.
  • The UK’s other constitutional regulators should be strengthened. Partly this is a matter of legislation (discussed below) but some improvements could be made purely by ministers. For example, the recruitment processes for the heads of key watchdogs should require a majority of fully independent members on the appointments panel to minimise partisan influence over the appointment of ethical regulators.
  • Another matter that lies in the Prime Minister’s power would be to reduce ministerial turnover (‘churn’) – which has long been identified as a challenge to effective policymaking. The results would not be seen immediately, but a commitment to this principle would be welcome.

The report on Richard Sharp raises big constitutional questions

The Heppinstall report into Richard Sharp’s appointment as BBC chair raised questions about possible reforms and has sparked calls for more far-reaching changes. Peter Riddell surveys such proposals, arguing that the merits of different options need to be carefully weighed.

The long-awaited report by Adam Heppinstall KC into the appointment of Richard Sharp as BBC chair has not only led to Sharp’s resignation, but also triggered a debate about changing how public appointments are made to reduce or eliminate the role of the Prime Minister. This links with many of the themes I discussed in my inaugural lecture at UCL on 26 April.

Having been Commissioner for Public Appointments at the time of Sharp’s appointment, I welcomed the setting up of the Heppinstall inquiry following the disclosure in January that Sharp had been involved – on his own account in a very limited way – in previously secret discussions about arranging financial support for Boris Johnson, the then Prime Minister, in autumn 2020 at the same time as he was applying to become BBC chair.

Heppinstall concluded that the original appointment process had been ‘good and thorough’ but that Sharp had breached the government’s Governance Code for Public Appointments by not disclosing to the advisory interview panel that he had met Johnson to inform him of his application and that he was going to meet Simon Case, the Cabinet Secretary, to attempt to introduce him to someone (Sam Blyth, a distant cousin of Johnson) who might assist the Prime Minister with his personal finances.  This created a potential conflict of interest and the risk of a perception that Sharp would not be independent from Johnson. The Sharp/Case meeting – and differences about what was said and recorded – has attracted considerable attention but is largely irrelevant, since Case never met nor contacted Blyth.

The UK’s constitutional norms and standards took a severe battering under Johnson: Labour should pledge to restore the system

There is no guarantee that the Johnson government’s dismal record on safeguarding our democracy will be improved upon by the new Prime Minister, Liz Truss. This creates big opportunities for Labour to offer a real alternative by restoring integrity and accountability to politics, writes Meg Russell.

Concerns about honesty and integrity and the erosion of constitutional norms were central to Boris Johnson’s dramatic downfall. The new Prime Minister’s attitudes in this area remain largely untested – though the omens during this summer’s leadership contest were not good. Meanwhile, public opinion research suggests that voters really care about these questions. That presents significant opportunities for Labour.

The charge sheet against Johnson was remarkably long. The journalist Peter Oborne, formerly political editor of the Spectator and a Telegraph columnist, dedicated both a website and a book to chronicling Johnson’s uneasy relationship with the truth. This trait was well known before he assumed the premiership and to an extent ‘priced in’. But the difficulties under his leadership went far wider, covering multiple aspects of integrity in politics and respect for the essential rules and norms that underpin UK democracy. This often put him at odds with regulators and non-political figures holding responsibility for maintaining the system, as well as with senior figures in his own party.

Parliament’s watchdogs: independence and accountability of five constitutional regulators

The Unit today published a new report, Parliament’s Watchdogs: Independence and Accountability of Five Constitutional Regulators. Robert Hazell explains that public awareness of these regulators is low and the position of some of them in public life is precarious. He calls for several measures, including putting the CSPL on a statutory footing, protecting watchdogs from dismissal, and repealing the legislation allowing the government to produce a strategy statement for the Electoral Commission.

Origins of this study

The constitutional reforms of the last 25 years have seen an upsurge in the number of constitutional watchdogs. The Constitution Unit anticipated these developments from the start, with an early report on constitutional watchdogs in 1997 (Unit report no. 10). This interest was continued by Oonagh Gay and Barry Winetrobe, who wrote two major reports on watchdogs: Officers of Parliament: Transforming the Role (Unit report no. 100, 2003) and Parliament’s Watchdogs: At the Crossroads(Unit report no. 144, 2008).

Today sees the launch of a new report, Parliament’s Watchdogs: Independence and Accountability of Five Constitutional Regulators, (Unit report 195), by Marcial Boo, Zach Pullar and myself. Marcial Boo, former Chief Executive of IPSA, joined the Constitution Unit in late 2020 as an honorary research fellow. We asked him to do a study of those watchdogs which are directly sponsored by parliament, working with Zach Pullar, a young law graduate who has since become a Judicial Assistant in the Court of Appeal. There is an obvious tension with watchdogs whose role is to scrutinise the executive (like the Independent Adviser on Ministers’ Interests), being themselves appointed and sponsored by the government. Less obvious, but just as fundamental, is the tension for watchdogs whose role is to regulate the behaviour of parliamentarians, being themselves appointed and sponsored by parliament.
