Standards in the 2024 party manifestos

The main party manifestos for the forthcoming general election have now been published, allowing exploration and comparison of their constitutional proposals. In this fifth post in a series on the manifestos, Lisa James looks at the parties’ policies on the standards system. What do they propose, what should they consider, and what might be missing? 

Standards scandals were a frequent feature of the 2019–24 parliament; MPs, ministers and even a Prime Minister were forced to resign amid controversy. In this context, expert bodies probed the strengths and weaknesses of the current system and suggested improvements, with major reports published by the Committee on Standards in Public Life (CSPL), House of Commons Public Administration and Constitutional Affairs Committee, Boardman Review into the Greensill lobbying scandal, House of Commons Standards Committee, Institute for Government, UK Governance Project and Constitution Unit. And public opinion research revealed a strong appetite for reforms to enforce high ethical standards. Coming into the 2024 general election, political parties had both the impetus to take standards reform seriously, and no shortage of recommendations for how to achieve it. 

This blogpost assesses the manifesto commitments on reforming ministerial and parliamentary standards made by the Labour Party, Liberal Democrats, Green Party and Reform UK, with most of its material coming from the former two. The Scottish National Party does not address standards at Westminster; Plaid Cymru’s key pledge, on criminalising lying by politicians or candidates, was addressed in a previous post. And strikingly, given the party’s experiences in the last parliament, the Conservative manifesto makes no mention of standards at all. 

An Ethics and Integrity Commission? 

The most significant pledge in the Labour manifesto is to create a new Ethics and Integrity Commission. This policy has been well-trailed, and was the centrepiece of two major speeches by Angela Rayner in 2021 and 2023. But the manifesto gives scant detail on the commission’s remit and scope, saying only that it will have a brief to ‘ensure probity in government’.

Changes in electoral practice since 2019

The coming general election is the UK’s first in approaching five years. Many changes have happened in how elections are done – partly through legislation, but partly also through informal shifts in the media, AI, and electoral administration. In this post, Sanjana Balakrishnan summarises all that is new.

The general election on 4 July will be the UK’s first since 2019. The intervening years have seen many changes to electoral process. These include important amendments in electoral law – most notably, but not exclusively, through the Elections Act 2022. They also include more informal shifts in, for example, the operating practices of social media companies and the capacity of local electoral administrators.

The breadth of these institutional changes means that July’s vote will be different from any previous UK general election. This post surveys the key points. It begins with legislative changes (on which the Hansard Society has offered an excellent and more detailed account) before turning to other innovations.

Elections Act 2022

The biggest set of reforms was introduced by the Elections Act 2022. Some of these changes related to local elections – see posts by the Unit’s Alan Renwick on mayoral and Police and Crime Commissioner (PCC) elections. The focus here is on those relevant to parliamentary elections.

After an unsuccessful legal challenge by All the Citizens and the Good Law Project, where next on WhatsApp use in government?

Cassandra Somers-Joce and Joe Tomlinson discuss the use of instant messaging technologies within government, arguing that good government does not mean the eradication of such technology from government practice, but that it must be used in a way that is sensitive to the state’s duties to maintain a record.

The last few years have seen several prominent examples of instant messaging technologies – some with the capacity to auto-delete messages – being used within the UK government. Examples ranging from the articulation of the rationale behind the controversial prorogation of parliament to the securing of government medical device contracts during the COVID-19 pandemic have arisen in the press. Instant messaging technologies clearly play an important role in government communication and decision-making. These technologies are seemingly utilised daily across all levels; for instance, the BBC has reported that since November 2020, Prime Minister Boris Johnson has been sent a summary of his ‘red box’, containing prime ministerial business to attend to, via WhatsApp. These reports of high-profile usage have been followed by the emergence of a Cabinet Office policy that arguably encourages the use of self-deleting instant messaging, and research from the Institute for Government that shows divergent policies on this issue across government.

What should we make of these quickly evolving practices? Instant messaging technologies such as WhatsApp undoubtedly have their benefits for public officials, and the effective functioning of government overall. Perhaps most notably, they can enable officials to exchange messages and share information more easily than other systems. However, they create a range of complexities as regards the preservation of the public record, particularly where these technologies are used in place of documented meetings or official email communications. Not least amongst these complexities is that the use of these technologies engages a variety of public law norms related to governmental record-keeping and the disclosure of information. As practices have emerged, it has become increasingly clear that the use of WhatsApp by the UK government may be at risk of being in violation of these public law norms.

Responding to the coronavirus ‘infodemic’: some lessons in tackling misinformation

Government, social media companies, and others have taken concerted action against it. Michela Palese and Alan Renwick here examine these responses and consider potential lessons for tackling online misinformation more broadly.

COVID-19 is rightly dominating the international agenda. Besides the crucial health, economic, and social dimensions, considerable attention is being paid to the information on COVID-19 that is circulating online. 

Ever since the virus emerged, false, misleading and/or harmful information has spread, especially online. Newsguard, which ranks websites by trustworthiness, found that, in the 90 days to 3 March, 75 US websites publishing coronavirus misinformation received ‘more than 142 times the engagement of the two major public health institutions providing information about the outbreak’. Ofcom found that ‘[a]lmost half of UK online adults came across false or misleading information about the coronavirus’ in the last week of March. The World Health Organisation (WHO) described the misinformation as an ‘infodemic – an over-abundance of information – some accurate and some not – that makes it hard for people to find trustworthy sources and reliable guidance when they need it.’

The capacity of social media and 24/7 news to proliferate misinformation was already manifest. But this is the first time the potentially nefarious effects of an unregulated online space have combined with a global pandemic. As Conservative MP Damian Collins put it, this is the ‘first major public health crisis of the social media age’.

Governments and tech companies across the globe are responding. In this post, we highlight key steps and consider lessons for dealing with misinformation in general. Continue reading
