Revisiting Tony King’s analysis of executive-legislative relations shows just how much parliament has changed

meg-russellPhilip.Cowley.2016The inaugural issue of Legislative Studies Quarterly contained one of Tony King’s most insightful pieces on parliament and politicians. It is still regularly cited, and has influenced the analysis of a generation of parliamentary scholars. In this blog post, Meg Russell and Philip Cowley analyse the extent to which King’s conclusions hold true in a parliament that looks significantly different to its 1976 counterpart.

Parliaments are not monoliths, they are highly complex political organisations. Anthony King’s 1976 article ‘Modes of executive–legislative relations: Great Britain, France and West Germany’ was one of the first to point out the importance of the multiple relationships inside legislatures – including some relationships that are often hidden from view.

King argued that the most important of these in the British parliament was the ‘intraparty mode’: between the government and its own backbenchers. Others, such as the ‘non-party mode’ or ‘cross-party mode’, he judged to be weak at Westminster.

King’s objective was to strip away the noise and present parliamentary dynamics as a set of stylised relationships between different actors. The fundamentals of this analysis have stood the test of time very well in the last 40 years, and the article remains a classic. But since it was published, a great deal has also changed. We review these changes, and their effects on his conclusions, in a recently-published article in the Political Quarterly entitled ‘Modes of UK Executive-Legislative Relations Revisited’.

British politics and what we’ve learned after the 2017 general election

Last month’s general election delivered the latest in a series of political surprises, with the Conservatives falling short of a majority when many had anticipated they would win a landslide. On 21 June the Constitution Unit hosted a panel of election experts consisting of YouGov’s Joe Twyman and academics Justin Fisher, Jennifer Hudson, Philip Cowley and Alan Renwick to reflect on what happened. Although we have become used to political upsets in recent years the outcome of the 8 June election nonetheless came as a surprise to many, including the Prime Minister, who saw her majority disappear when she had hoped to increase it substantially. How did this happen? How did the Conservatives manage to lose the massive lead they held at the start of the campaign, and Labour out-perform all expectations? How did the pollsters do after they had failed to call the 2015 election correctly? And what does the result mean for the government’s position in the new parliament, and for Brexit and beyond? These questions were all discussed at a Constitution Unit seminar held on 21 June, chaired by the Unit’s Director Professor Meg Russell. The panel included YouGov’s Joe Twyman, Professor Justin Fisher from Brunel University and Professor Philip Cowley from Queen Mary University of London. Dr Jennifer Hudson and Dr Alan Renwick from the Constitution Unit completed the line-up.

Joe Twyman

Joe Twyman opened the seminar with a brief post mortem on YouGov’s 2015 general election polling, which had predicted that the Conservatives would be the largest party in a hung parliament. The Conservatives went on to win 330 seats, securing a small but workable majority. YouGov subsequently identified three problems in the 2015 polling process: the samples used by YouGov and other polling companies to measure voting intention were not representative; figuring out whether people will turn out to vote is challenging; seat estimation across 650 constituencies is inherently very difficult.

Twyman then described how YouGov has responded to these issues. First, it has invested heavily in targeted recruitment, spending more than £100,000 in the last year to identify and recruit the types of people who were underrepresented in YouGov samples between 2010 and 2015, particularly those who were not interested in politics. Second, YouGov has updated how it analyses turnout. Thirdly, it has also developed a new seat estimation model.

This seat model, as is now well known, correctly predicted a hung parliament. In the run up to June 8 YouGov faced trenchant criticism, both from established commentators and on social media. Twyman reflected on Paul Krugman’s statement after the US election results that economists and commentators ‘truly didn’t understand the country we live in’. Through the efforts of YouGov, according to Twyman, we do now understand the country we live in a little better.

Justin Fisher

Justin Fisher began his contribution by drawing the audience’s attention to how important lead time ahead of an election is for party campaigns. The national and constituency campaigns have merged, with national campaigns now supporting the constituency effort. Lead time gives parties more time to plan targeting, information distribution, spending and fundraising. In a normal election campaign the critical period is the six-to-nine months before the poll.

The snap election left no opportunity for such advance campaigning. One implication is that this is likely to have been a much less expensive campaign than usual. Another is a shift in emphasis in campaigning techniques from direct mail (which requires lead time) to face-to-face campaigning and e-campaigning, which require much less preparation time. Fisher stressed that the evidence needed to confirm these expectations is still being collected.

Though the 2017 election may have accelerated the shift to e-campaigning, Fisher argued that campaigning techniques were partly heading that direction regardless. He also warned of what he called e-campaigning myths. He debunked the myth that micro-targeting of voters had only just been invented: parties have gathered data from phone calls and indirect mail for years. E-campaigning, therefore, represents evolution rather than a revolution. A further myth is the claim that because parties are using e-campaigning it must be effective. In 2015, research found it to be electorally effective, but less so than face-to-face campaigning. This has yet to be examined for the 2017 election.

How parliament influences policy: academic and practitioner perspectives

There is now a large body of academic research demonstrating that the Westminster parliament has considerable policy influence, yet claims that the UK has an executive-dominated political system persist. On 15 March Professor Meg Russell and Professor Philip Cowley, who between them have carried out much of the key research in this area, spoke at a Constitution Unit seminar on the policy impact of parliament along with Sarah Champion MP, who offered an insider perspective. Public and media discourse is often shaped by a longstanding assumption that the Westminster parliament is weak relative to the executive – but is this really true? A closer look demonstrates that it is a complex and often misunderstood institution. On 15 March the Constitution Unit, in collaboration with the Hansard Society and the Parliament and Constitution Centre of the House of Commons Library, hosted a seminar in parliament with Professor Meg Russell (Director of the Constitution Unit), Professor Philip Cowley (Queen Mary University of London), and Sarah Champion MP, to discuss parliament’s policy impact.

The legislative process, the Lords and select committees

Speaking first, Meg Russell suggested that the constant portrayal of parliament as a weak institution should be a matter for concern, as perpetuating an inaccurate assumption may drive down trust in the political process. The impact of parliament on policy has been a major strand of the Unit’s research in recent years, including extensive work on the legislative process, the House of Lords and select committees.

Tracing amendments in both chambers on 12 bills (2005-2012) revealed that although at first glance government amendments were much more successful than non-government amendments (94 per cent were passed, compared to 0.7 per cent of non-government amendments), in fact 60 per cent of government amendments that made substantive policy change were traceable to parliamentary pressure, mostly through previous non-government amendments. Select committee recommendations can also lead the government to bring forward amendments of their own , notably including the reversal of the Labour government’s manifesto policy on smoking in public places from a partial to a complete ban. These findings are elaborated in an article by Meg Russell, Daniel Gover and Kristina Wollter, recently published in the journal Parliamentary Affairs.

The policy power of the Westminster parliament: The empirical evidence

The UK parliament continues to be dismissed as powerless in many academic and popular accounts. Drawing on a large body of quantitative and qualitative research conducted over more than 15 years, a recent article by Meg Russell and Philip Cowley argued that the Westminster parliament is in fact an institution with significant policy influence. Meg Russell summarises here.

In the study of public policy, legislatures tend to be portrayed as relatively weak institutions. This applies to the UK parliament in particular. The classic comparative view associates the Westminster model, of which the UK is seen as the emblematic case, with centralised executive power and an acquiescent legislature. Assumptions of Westminster’s weakness are not, however, confined to comparative scholars or to the recent past. In a 2011 article Matthew Flinders and Alexandra Kelso traced gloom-laden statements of British parliamentary powerlessness back over a century and more. Meanwhile, a public policy textbook published in 2012 reflected the view of many scholars in the field when stating that ‘Despite the name “parliamentary democracy”, the parliament plays only a limited role in decision-making in the British Westminster model’ (p. 139).

Yet in recent years scholars specialising in the study of the UK parliament have found evidence of significant parliamentary influence on the policy process. This may in part be due to changes in parliamentary structures and behaviour, but also simply result from more exhaustive research approaches. I have contributed to this literature through my work on the House of Lords, and the policy impact of the Westminster parliament. Professor Philip Cowley has also contributed greatly, particularly through his work on the Commons. In a recent article in the journal Governance we drew these various strands together – using four large quantitative data sets, complemented by more than 500 interviews with key parliamentary and government actors – to demonstrate that Westminster’s influence is both substantial and probably rising. We conclude that parliament’s critics make two key mistakes – by concentrating largely on the decision-making stage of the policy process, and focusing almost exclusively on visible parliamentary impact (e.g. government defeats on legislation). We broaden the focus to take into account both visible and less visible impact, with a particular interest in anticipated reactions. Our arguments are summarised in this post.
